1. Acceptance of these Terms

These Terms of Service (“Terms”) form a legally binding agreement between you and [TODO: legal entity name] (“LaxForge,” “we,” “us”) governing your use of the LaxForge website at laxforge.app, the LaxForge mobile applications, the LaxPod hardware, and any related services (collectively, the “Service”). By creating an account, placing a preorder, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to create an account on your own behalf. Users under 13 may use the Service only with the verifiable consent of a parent or legal guardian, who agrees to these Terms on the user’s behalf. If you are using the Service on behalf of a minor, you represent that you have the authority to do so.

3. Account responsibilities

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us at security@laxforge.app immediately if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.

4. License grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. We retain all right, title, and interest in and to the Service, including all intellectual property rights. Nothing in these Terms transfers any ownership interest in the Service to you.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract our source code or model weights, except to the extent expressly permitted by applicable law.
• Use the Service to harass, abuse, or harm another person, or to collect data about others without their consent.
• Interfere with the operation of the Service, attempt to bypass usage limits, or scrape data at scale.
• Upload content that you do not have the right to share, or content that infringes intellectual-property, privacy, or publicity rights.
• Use the Service in any way that violates applicable law.

6. User-submitted content

You retain ownership of any video, sensor data, pose data, notes, and other content you submit through the Service (“Your Content”). By submitting Your Content you grant LaxForge a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and improve the Service for you. We will only use Your Content for model-training or product-research purposes if you have separately opted in, or where we [TODO: describe permitted aggregate / de-identified uses].

You represent and warrant that you have all necessary rights to submit Your Content and to grant the license above.

7. Preorder & deposit terms

Placing a preorder on /preorder reserves your spot in the LaxForge v1 production run. The deposit amount is [TODO: $49 USD (confirm exact)], charged at checkout via our payment processor.

• Refundable on request: Your deposit is fully refundable for any reason within [TODO: X days] of the order, and at any time prior to the shipping notification, by emailing support@laxforge.app.
• Ship-by-or-refund commitment: If we have not shipped your unit by [TODO: target ship date], you may cancel for a full refund.
• Final price & balance: The deposit is applied to the final purchase price. The remaining balance and any taxes, duties, or shipping fees will be quoted before shipment and you will have the opportunity to cancel before the balance is charged.
• Changes to the product: We may make non-material specification changes during development. If a material change is made, we will notify you and offer a refund.

8. Subscriptions & in-app purchases

The LaxForge mobile app [TODO: describe whether and which features are subscription gated]. Subscription terms, billing cycles, and trial details will be presented to you at the time of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period via your platform’s subscription settings (Apple App Store, Google Play, or our website).

9. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, LaxForge disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. LaxForge analyzes lacrosse mechanics for training and feedback; it is not a medical, diagnostic, or injury-prevention device, and should not be relied on for those purposes.

10. Limitation of liability

To the maximum extent permitted by law, LaxForge and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Service. Our aggregate liability for any claim arising under these Terms will not exceed the greater of [TODO: $100 USD] or the amount you paid LaxForge in the twelve months before the claim arose.

11. Indemnification

You agree to defend, indemnify, and hold harmless LaxForge from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party right.

12. Termination

You may stop using the Service and delete your account at any time by emailing support@laxforge.app. We may suspend or terminate your access for material breach of these Terms or where required by law. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

13. Dispute resolution & arbitration

Informal resolution first. Before filing a formal dispute, please contact legal@laxforge.app so we can try to resolve the issue.

Arbitration. Any dispute arising under these Terms that we cannot resolve informally will be resolved by binding arbitration administered by [TODO: AAA / JAMS / other] under its [TODO: consumer arbitration rules], in [TODO: seat of arbitration, e.g. Wilmington, Delaware]. Either party may seek injunctive relief in court for intellectual property infringement.
